Safety Cameras - Human rights?

My boyfriend was pictured at a set of traffic lights on his mobile phone in his lorry, way back in may the police havnt yet got a hold of his name as there was a period of time where they were taking no action and his employers were holding them of but lately they have been putting on the pressure but i was wondering if it was an infringement of his human rights for them to keep and hold his picture without charge for this length of tim and also to have a picture of him will inside private property.
